KMU URGENT ACTION ALERT

Dear friends,

At 1p.m. yesterday (23 October 2008), Atty. Remegio Saladero Jr. was arbitrarily arrested in his house-cum-law office in Antipolo, Rizal on a defective warrant of arrest supposedly charging him with frustrated and multiple murder. He was arrested by members of the Antipolo police and was brought to Camp Vicente Lim in Laguna. He was put in the same stockade where the Tagaytay 5 (peasants and peasant advocates arrested on April 2006) were also held for more than 2 years.

Atty. Saladero Jr. is the chief legal counsel of Kilusang Mayo Uno (KMU), Pro Labor Legal Assistance Center's (PLACE) Board Chairman, Anakpawis Partylist's Legal Counsel, National Federation of Labor Unions (NAFLU)-KMU chief legal counsel and a member of the National Union of People's Lawyers (NUPL), among others. He graduated law at San Beda College and was among the top 20 when he took the bar in 1984. He was also a law professor at the Lyceum and the Dominican College. He is also a columnist at the on-line newspaper Pinoy Weekly.

His wife Maricel alerted KMU about the incident at around 7pm last night. Based on her accounts, she went to another town that day but they were supposed to meet at their house at 3pm. When she arrived, she noticed that both the gate and the front door was closed but not locked. As Atty. Saladero was nowhere to be found, she tried to contact him at his two mobile numbers but both can't be reached. Later, she found out that a personal computer and a laptop were missing. After a few hours of waiting, she called the office of NAFLU-KMU to seek support.

Following this information, his colleagues and friends in KMU, PLACE, Anakpawis and others immediately organized a quick response team (QRT) to search him. The media was also alerted about the abduction.

At around 9pm last night, Atty. Remegio was able to call his wife and told her that he is presently detained at Camp Vicente Lim in Laguna. A contingent composed of KMU leaders and members in Manila and Southern Tagalog together with a delegation from Anakpawis Party List immediately went to the camp. The military guards initially refused entry to the contingent but eventually relented.

In a brief talk with talk with Atty. Saladero, he said that that police elements from Antipolo arrested him on charges of frustrated and multiple murder in Mindoro. There was no specific murder case mentioned. It was a defective warrant of arrest - his name was misspelled (Remegio, instead of Remigio, Jr.) and the written address was Los Banos, Laguna. It was clearly an intentional flaw, so as to surprise him with the warrant. It was also meant to keep him away from the preliminary hearing on Oct 30 on another arson case filed against him together with 26 others. There was no preliminary investigation on this latest frustrated and multiple murder case filed against him.

Atty. Noel Neri, Saladero's colleague at the PLACE, said that the defective warrant of arrest used for Atty. Saladero was dated Oct. 8, 2008 and it is a non-bailable charge.

The frustrated and multiple murder charge is on top of cases of arson, destruction of property and conspiracy to commit rebellion lodged against him and 18 other activists and numerous John Does in relation to the bombing of a Globe cell site in Lemery, Batangas on August 2, 2008. Atty. Saladero is being accused as a member of the New Peoples Army (NPA).

Just before 7:00 this morning, military elements escorted Atty. Saladero out of Camp Vicente Lim, on a red Toyota vehicle without a plate number. He is now being transported to Mindoro where he will face the charges filed against him. Some leaders of NAFLU-KMU also went to Mindoro to check on where he will be transferred.

This incident is the latest desperate attempt to harass and frighten Atty. Saladero and other PLACE lawyers for handling even the most controversial labor cases on pro-bono basis such as the Hacienda Luisita and Nestle Philippines. PLACE handles around 700 labor, human rights, criminal, civil and administrative cases on pro-bono basis. Harassments to PLACE law office started in 2006, during the height of political turmoil experienced by the Arroyo government. PLACE had been under intense surveillance for months since then.

Please write to authorities asking the government to clear the name of Atty. Remigio Saladero and stop tagging him as a rebel. Drop the cases of arson, destruction of property, conspiracy to commit rebellion and frustrated and multiple charges filed against him. Create an independent investigating team to look into the series of surveillances to PLACE law center.

Account of Incident:

Around 1 P.M. of 23 October 2008, Atty. Remigio Saladero Jr., a labor lawyer of Pro-Labor Legal Assistance Center (PLACE) and chief legal counsel of labor organization KMU, was working in his office when an unidentified man in plainclothes came in and asked if he is Atty. Saladero. He said yes.

The man left, and returned in police uniform together with several other police officers from PNP-Antipolo. He was shown a defective warrant of arrest (bearing the wrong name, i.e. Remegio Saladero alias Ka Patrick and address i.e., Los Baños, Laguna). Charges of Multiple Murder and Multiple Frustrated Murder dated 6 October 2008 was reflected on the warrant. The said warrant was issued by Branch 40 of Mindoro Oriental RTC in Calapan City.

Atty. Saladero was handcuffed and forcibly taken out of his office. His mobile phone, computer CPU (central processing unit) and a laptop were also taken by the police.

He was first taken to the Rizal Provincial Police Headquarters in Antipolo where the arresting officers took his picture. The police refused Atty. Saladero's assertion of his right for a phone call to inform his family of his whereabouts.

Later, he was transferred to Camp Vicente Lim in Laguna. At past 8P.M., he was able to call his wife, Maricel. She arrived at Camp Vicente Lim at around 11:30 P.M., accompanied by Atty. Noel Neri of PLACE and the human rights Quick Reaction Team (QRT) composed of KARAPATAN-National, AnakPawis Partylist and KMU members.

At first, the police refused to allow Maricel and Atty. Neri to talk to the victim. After a heated argument, the two were finally allowed to speak to Atty. Saladero but only for a short time.

The QRT stayed in the area until the morning of October 24 to ensure that no further violation will be committed against Atty. Saladero.

At around 6:30AM the following day, October 24, Atty. Saladero was made to board a red Toyota Corrolla with no plate and was transported to Batangas Pier to be taken to Calapan City.

By 10 in the morning, another human rights team was already waiting for Atty. Saladero at the Branch 40 of Mindoro Oriental RTC in Calapan City. The team was alarmed that after five hours of waiting, Atty. Saladero has yet to be presented in Court. Calapan City is about an hour and 45 minutes travel via ferry from Batangas Pier.

While waiting for Atty. Saladero, the paralegal of the team asked a court clerk for the documents of the charges filed against the labor lawyer. But he was refused citing various reasons.

Later, at around 4 P.M., Atty. Saladero and his custodians finally arrived at the court. He was then brought to Calapan City Provincial Jail.

Atty. Saladero was a professor at the Lyceum of the Philippines University and Dominican College, both in Metro Manila. He is also a columnist of Pinoy Weekly, an online newspaper where he writes about various labor cases in the Philippines.

He is a member of PLACE which handles around 700 pro-bono cases on labor, human rights, criminal, civil and administrative cases. PLACE, being a progressive labor law office, has been subjected to harassments and surveillance from unidentified men believed to be military agents.

Atty. Saladero is also charged with arson and conspiracy to commit rebellion together with other 26 activists for allegedly burning a Globe cell site in the town of Lemery in Batangas province last August 2, an incident already claimed by the New Peoples Army (NPA).

RECOMMENDED ACTION:

Send letters, emails or fax messages calling for:
1) The immediate formation of an independent fact-finding and investigation team composed of representatives from human rights groups, the Church, local government, and the Commission on Human Rights that will look into the illegal arrest and detention of Atty. Remigio Saladero Jr.
2) The military to stop the labeling of human rights defenders as "members of front organizations of the communists" and "enemies of the state."
3) The immediate release of Atty. Saladero.
4) The Philippine Government to be reminded that it is a signatory to the Universal Declaration of Human Rights and that it is also a party to all the major Human Rights instruments, thus it is bound to observe all of these instruments' provisions.

Arroyo government targets labor and peasant leaders, using tactic of political persecution through legal charges

Anakpawis Rep. Rafael Mariano condemned the illegal arrest and
detention of labor lawyer Atty. Remigio Saladero Jr., the Chief Legal
Counsel of militant labor group Kilusang Mayo Uno (KMU) and also a
lawyer of Anakpawis Partylist.

Saladero was arrested yesterday afternoon in Antipolo City by combined
police and military elements led by the Antipolo Police and Military
Intelligence Group 4A of the Intelligence Service of the AFP (ISAFP).

He was arrested based on a warrant issued by a court in Calapan,
Oriental Mindoro and was charged with multiple murder, frustrated
murder with no bail recommended. He was detained at the Camp Vicente
Lim in Laguna until this morning and was hurriedly transferred to
Mindoro for a hearing on the cases against him.

Saladero, along with 26 other leaders and members of local peasant,
fisherfolk, workers and urban poor organizations in Southern Tagalog
were also implicated in the torching of a Globe cellsite in Lemery
Batangas last August 2. The accused activists collectively known as
the 'Globe 27' were charged with arson, inciting to commit rebellion
and destruction of property by Globe Telecoms and the Philippine
National Police (PNP).

 

 

Mariano added, "the charges against the 'Globe 27' are weak and
baseless so the PNP and AFP concocted other cases to pin down Atty.
Saladero. The latest murder charges against Atty. Saladero are
fabricated. Accusing a fulltime lawyer of bombing a cellsite and
murder is simply preposterous."

Saladero is also helping the Anakpawis Partylist solon in studying the
proposed House Bill on Labor Code Amendments and other legislative
matters. He has helped found Anakpawis Partylist in 2003.

Atty. Meng is 49 years old and even with heart and diabetic conditions
he still handles more than 700 labor cases.

The militant solon said that the Arroyo government must be stopped
from exploiting the Courts and the justice system to persecute
activists and leaders of progressive people's organizations.

"Under Arroyo's rule, blind justice prevails. The Arroyo government
has adopted the dirty tactic of filing fictitious charges against
progressive individuals who are actively exposing and opposing
corruption and anti-people policies. The main targets of political
persecution through legal offensives are progressive labor and peasant
leaders."

Meanwhile, Rep. Mariano also demanded the surfacing of Anakpawis
Partylist Rizal Provincial Coordinator Nestor San Jose. He was
abducted by still unidentified armed men at the Teresa Public Market
in Teresa Rizal at around 9 am this morning. He is one of the accused
in the Globe 27 case. He remains missing and his whereabouts is still

CTUHR slams Arroyo government for illegal arrest of labor lawyer Remigio Saladero

Labor rights group Center for Trade Union and Human Rights (CTUHR) strongly condemns the illegal arrest of Atty. Remigio Saladero Jr., by the combined forces of police and military in his house in Antipolo city yesterday.

He was arrested based on charges of murder and frustrated murder he allegedly committed in Mindoro.

The arresting officers illegally confiscated all his cell phones, laptop and CPU. The police also took his Toyota corolla vehicle 7am this morning.

"These fabricated charges only shows how desperate our government to impede the labor movement," CTUHR executive director Daisy Arago said.

"Saladero is not an NPA. He is a full-time lawyer and columnist. We have been working with him for almost a decade now, giving free legal assistance to workers. He is a people's lawyer," she said.

His arresting officers were identified as RIID4A F. Fernando and PO1 R. Osis. The arrest was conducted by joint elements of RIID 4A, PIB, Rizal PP0 418th PPMG, Antipolo and Military Intelligence Group 4A-Intelligence Service of the Armed Forces of the Philippines (ISAFP).

 

 

Saladero faces serious threat to his life and security. He was placed under the custody of the military in Camp Vicente Lim in Los Banos Laguna yesterday. His family and colleagues were alarmed on his condition when they saw him looking too tired and frail.

"The government will be held accountable to anything bad that might happen to his health. Atty. Saladero experienced two strokes already… we are afraid he needs medical assistance."

By 7am today, Gen. Padilla told to DZRH that Saladero is still in the camp at peace and they were well-informing his colleagues about his transfer to Calapan Oriental Mindoro.

However, it was later found out that they had already transferred him as early as 6:30am. CTUHR had also received reports that the military used a Toyota car without a plate number for his transfer to Mindoro

"They never faced us about their plans to transfer him," CTUHR correspondent said. "They are keeping the public from knowing about his condition."#

HUMAN RIGHTS LAWYERS CONDEMN ATTACK ON THEIR RANKS

The National Union of Peoples' Lawyers (NUPL), the International Association of People's Lawyers (IAPL), Pro-Labor Legal Assistance Center (PLACE), SENTRA and the Public Interest Legal Center (PILC) condemn the abduction and illegal arrest of Atty. Remigio "Ming" Saladero, Jr, a member of the NUPL, the chief legal counsel of Kilusang Mayo Uno (KMU) and Board Chairperson of the Pro-Labor Legal Assistant Center (PLACE). Atty. Saladero is a human rights lawyer who was one of those who argued before the Supreme Court on the constitutionality of Pres. Gloria Arroyo's calibrated preemptive response policy. He is also a member of the media as a columnist of Pinoy Weekly. He is a respected labor lawyer handling nearly 700 labor cases before various tribunals.

A group of armed men claiming to be members of the PNP barged into the office of Atty. Ming on October 23 showing a 2006 warrant of arrest for multiple murder and multiple frustrated murder cases in the Regional Trial Court in Calapan City, Oriental Mindoro.

The attack against Atty. Saladero is a violation of his right to due process considering that he was never informed about the complaint and was not able to defend himself before a warrant of arrest was issued. It is also an attack against the legal profession since Atty. Saladero was harassed for the exercise of his profession. It is a blow the right to counsel and access to justice by many workers and human rights victims whose cases Atty. Saladero is handling.

The case filed against Atty. Saladero is part of the Arroyo government's attempt to cow human rights advocates critical of the policies of Pres. Arroyo. Atty. Saladero have been subjected to various attacks in the past mostly from military for his being the lawyer of suspected members of the New Peoples' Army in Rizal. He was also one of the respondents in the case for Conspiracy to Commit Rebellion, Arson and Destruction of Property filed by the military and Globe Telecoms against 27 leaders and activists from Southern Tagalog Region in connection with bombing of Globe Cellsite in Lemery Batangas on August 2, 2008. These trumped-up charges have no basis in fact. Atty. Saladero is not a member of the New People's Army and is not a fugitive. He has been openly litigating in courts and has never been involved in any case of arson to blow up Globe cellsites.

PLACE said the illegal arrest of Atty. Saladero and his possible prolonged detention will adversely affect the operation of PLACE. "Atty. Saladero handles most of the 700 cases of PLACE. Not only that, his other cases mostly human rights and pro bono will be also affected" said Atty. Noel Neri, member of NUPL and colleague of Atty. Saladero in PLACE.

Members of the legal profession, particularly human rights lawyers, will not take this recent attack sitting down. The raiding team members are criminally liable for qualified theft when they confiscated the desktop computer, laptop and cellphone of Atty. Saladero when they executed the supposed warrant of arrest. We will file criminal and administrative cases against public officials who facilitated the illegal arrest and harassment case against Atty. Saladero and false witnesses who committed perjury in their affidavits. The Supreme Court has chastised the Department of Justice for "prostituting" their office to harass political opponents of Pres. Arroyo. We will make sure that those responsible for the travesty of Atty. Saladero's right to due process will be held liable for their participation in the scheme to harass a human rights lawyer who sacrificed so much for the interest of human rights. We ask the Integrated Bar of the Philippines to immediately call for the release of Atty. Saladero and condemn this attack on the legal profession.

Peasant group denounces abduction of labor lawyer
KMP calls on Chief Justice to remind judges on issuing arrest warrants,
judges not to be instruments of creeping martial law

The militant Kilusang Magbubukid ng Pilipinas (KMP, Peasant Movement of the Philippines) totally denounces the latest arrest of labor lawyer Atty. Remigio Saladero by the PNP and military intelligence agents. Atty. Saladero, a member of PLACE (a pro-bono lawyers' group), is the chief legal counsel of the labor group Kilusang Mayo Uno (KMU) who handles labor cases in Southern Tagalog region. He was one of the `Southern Tagalog 27' or `ST 27' the leaders and members of militant organizations under Bagong Alyansang Makabayan from the said region, who were filed against with arson and conspiracy to commit rebellion, and accused as an NPA member last month.

Atty. Saladero was arrested on a raid at his house in Antipolo and his laptop and desktop computer stolen by the military and police at about 4pm and was only spotted by family and friends at about 9pm at Camp Vicente Lim. The government forces used an arrest warrant for multiple murder and frustrated murder charges from Mindoro province.

"This is really the creeping martial law," Danilo Ramos, KMP Secretary-General opened on a press statement today. "The Arroyo government is really commencing on pushing the limits of their counter-insurgency program, taking advantage of the rotten legal system to imprison activists and supporters, this is really the `dark age' for human rights in the Philippines," he added.

KMP has their share of leaders being arrested like Randall "Ka Randy" Echanis who is now behind bars at the Manila City Jail for multiple murder charges in Hilongos town, Leyte. Echanis is the KMP Deputy Secretary-General for External Affairs arrested last January 28 in Bago City, Negros Occidental while consulting with agricultural workers regarding the HB 3059 or Genuine Agrarian Reform Bill sponsored by Anakpawis Partylist in Congress.

"The Arroyo government is treating progressives like fruits to be harvested, waiting for the right time, then, their fascist forces to pick them up, if not to gun them down," analogized Ramos. "Only a dictator could execute this kind of plan, we are in a dictatorship, where those who oppose Arroyo are in eliminated and imprisoned, her regime is no different to the Marcos dictatorship," observed Ramos.

"Our situation is really like a bad joke, where fabricated evidences, made-up testimonies are considered by supposedly honorable judges to issue arrest warrants, thus, we call on their attention to think twice and thrice before issuing warrants for cases filed by the police and military against leaders and members of legal-democratic organizations," reminded Ramos. He added, "Judges should consider seriously the social context of the cases the police and military are filing, once they do so, they would realize that they are being used by the Arroyo government against the struggling people."

"We are now reminded by the `Access to Justice' program of Chief Justice Puno, we are happy to see on the news that his mobile court could release deserving prisoners around the country, but if the cases such as of Atty. Saladero and our Ka Randy continue, his goal would be negated as the innocent continues to be imprisoned by Arroyo," Ramos remembered. "It is really intriguing that judges supposedly under his guidance continue to play puppets to the PNP and AFP. We are again reminding the Chief Justice to act more dynamically on our predicament, as injustice continue to cloud our society, perpetrated by Arroyo and her agents, the AFP and PNP," Ramos added.

"If the oppression and violation of rights continue, the struggling people would be pushed to the wall and forced to act outside the legal framework to defend their rights, if that comes to that, we are only to blame Arroyo, the courts, the whole legal system that played against the people, and those who never stood up for the defense of the people," Ramos declared.#
