Mga kaanak ng mga bilanggong pulitikal nanawagan ng pagpapalaya
"Palayain ang aming mga kaanak na bilanggong pulitikal!"

Muling sumugod ang mga kaanak ng mga mga bilanggong pulitikal o political prisoners, kasama ang iba pang kaanak ng mga biktima ng paglabag sa karapatang pantao at mga tagasuporta nila sa harapan ng Department of Justice (DOJ) upang muling igiit ang panawagang palayain ang lahat ng bilanggong pulitikal sa pamamagitan ng pagbibigay sa mga ito ng General, Unconditional at Omnibus Amnesty.

"Ang aming mga mahal sa buhay ay inaresto, tinortyur, ikinulong at sinampahan ng mga gawa-gawang kasong kriminal," ani ng grupong Hustisya o Pagkakaisa ng mga Biktima para sa Hustisya – organisasyon ng mga kaanak ng mga biktima ng paglabag sa karapatang pantao. “Sila ay nakabilanggo ngayon dahil sa kanilang pampulitikang paniniwala,” paliwanag nila.

"Umupo ang ating Pangulong si Noynoy Aquino hatid ang pag-asa sa aming magagawa niya ang ginawa ng kanyang inang si dating Pang. Corazon Aquino," ayon sa Hustisya. Pinalaya ng dating Pang. Corazon Aquino ang karamihan sa mga bilanggong puitikal sa unang taon pa lamang ng kanyang panunungkulan sa pagbibigay sa mga ito ng General Amnesty. Lahat ng mga kinilalang nagrebelde o lumaban para mapatalsik ang dating Pang. Marcos ay pinalaya, dagdag pa ng grupo.

Panawagan ngayon ng mga kaanak ng mga bilanggong pulitikal na palayain din ang kanilang mga mahal sa buhay sa ilalim ng General (pangkalahatan), Omnibus (pagpapawalang bisa sa lahat ng isinampang kaso) at Unconditional (walang hinihinging kundisyon o kapalit) na Amnestiya. “Inaasahan naming magagawa rin ito ng kanyang anak,” patuloy ng Hustisya.

Ipinahayag rin ng Hustisya ang pagkadismaya nito sa hindi pagkakatuloy ng nakatakdang Usapang Pangkapayapaan ngayong Hunyo sa pagitan ng Gobyerno ng Plipinas (GPH) at ng National Democratic Front of the Philippines (NDFP) at sa hindi pagtupad ng GPH sa pagpapalaya sa mga bilanggong pulitikal mula sa kasunduan na naganap noong huling usapan nito.

"Masakit para sa aming na makitang nagtatagal sa kulungan ang aming mga mahal sa buhay; na hindi sila makapiling sa mga importanteng okasyon dahil sila ay nakapiit; na nagdudusa sila sa masikip at hindi makataong kalagayan ng bilangguan," sabi ng organisasyon. “Lalo pa at ang turing sa kanila ay mga kriminal, samantalang wala silang ibang hinangad kundi ang mapayapang lipunan.”

"Hindi kriminal ang aming mga kaanak, sila ay mga taong naglilingkod sa sambayanan - pagkakasala ba iyon?" Tanong nila. Former political prisoners call for general, unconditional and omnibus amnesty for all political prisoners

Former political prisoners led by the Samahan ng Ex-detainees Laban sa Detensyon at Aresto (SELDA) today joined human rights and people’s organizations in a rally at the Department of Justice in Manila to demand for the release of all political prisoners through general, unconditional and omnibus amnesty for 335 political prisoners (as of February 2011) in 67 detention centers nationwide.

Angelina Ipong of SELDA said that these political prisoners continue to languish under inhumane conditions inside jails in the almost one year of the Noynoy Aquino presidency. Ipong, a former lay missionary and peace consultant, was released last February 2011, after six years of imprisonment. She was 60 years old at the time of her arrest in 2005 and was subjected to beatings, sleep deprivation, psychological torture and sexual molestation in the hands of the Southern Command of the AFP.

“The demand for general, unconditional and omnibus amnesty for all political prisoners is but just and reasonable because all of them are victims of the Arroyo government’s covert policy of political persecution against persons with different political beliefs. They are charged with fabricated common crimes, conveniently hiding the political nature of their cases, thereby hiding the systematic political persecution committed against people like them,” she asserted.

Ipong also added that the circumstances of their arrests also reveal the pattern and rampant practice of illegal arrests and detention in the country: most of the time arresting authorities have no arrest warrants or have faulty and hastily secured warrants. Thus, their arrest and incarceration are meant to silence them, break their spirits and muffle their legitimate voices of opposition and dissent to government policies detrimental to the people’s democratic rights and interests.

Secretary Leila de Lima personally received the list of political prisoners submitted by human rights group Karapatan while small doves were carried by the rallyists to symbolize their call for the release of political prisoners.

“Just as what former president Cory Aquino did after Marcos was ousted, when she gave general and unconditional amnesty to all political prisoners, we urge Pres. Noynoy Aquino to follow the footsteps of her mother and pave the way for the release of political prisoners,” she concluded.

The Samahan ng Ex-Detainees Laban sa Detensyon at Aresto (SELDA) is an organization of former political prisoners in the Philippines. Founded on December 4, 1984, SELDA was initiated by newly-released political prisoners of the martial law period. SELDA’s primary task is to work for the release of all political prisoners and to see to it that humane treatment of those who are still in detention are complied with by the Philippine authorities. WOMEN’S RIGHTS GROUP SUPPORT CALLS FOR GENERAL, UNCONDITIONAL AND OMNIBUS AMNESTY FOR POLITICAL PRISONERS

Women’s rights group Tanggol Bayi today joined human rights organizations led by Karapatan and the Samahan ng Ex-detainees Laban sa Detensyon at Aresto (SELDA) in calling for the release of all political prisoners via a presidential proclamation granting general, unconditional and omnibus amnesty.

Cristina Palabay, convenor of Tanggol Bayi, said such demand underscores the situation of the 335 political prisoners (as of February 2011), who were illegally arrested, tortured, detained and charged with common crimes, most of them under the Macapagal-Arroyo administration.

“Most of the political prisoners are human rights defenders, who have been very active and vocal in defending the political, economic and socio-cultural rights of the people. They were slapped with common crimes to hide the very nature of the rights violations against them – that they are being persecuted and their political actions repressed,” she explained.

Palabay said there are 30 women political prisoners among the 335 political prisoners including the following: Maria Luisa Purcray, a peace consultant in Northern Mindanao region, who is currently detained at the Butuan City Jail; Maricon Montajes, a 23-year old film student from the University of the Philippines-Diliman currently detained at the Batangas Provincial Jail; Moreta Alegre, a 64-year old farmer who was arrested for alleged murder charges in 2004, currently detained at the Correctional Institution for Women (CIW); and Rowena Quilop, administrative officer of Bacolod-based non-government service organization Center for People’s Resources and Services (CPRS) and a board director of Ma-ao Parish Multi-Purpose Cooperative Inc. (MPMPCI), who was arrested in March 3, 2011 and currently detained at the Negros Occidental Provincial Jail.

“The continued incarceration of these women human rights defenders impedes their work in pursuit of women’s human rights. We support the call for general, unconditional and omnibus amnesty as all fabricated charges against political prisoners should be dropped or dismissed and their immediate release should have no preconditions,” she concluded.

“Prove the people wrong, Mr. President, release the political prisoners, now!” said Karapatan chairperson Marie Hilao Enriquez.

Enriquez added that, “today is 349th day of the President in office, 16 days short before he hits one year of his presidency yet, there are still 335 (as of February 2011) political prisoners languishing in 63 jails all over the country. Worse, these political prisoners are suffering in jail because of trumped up charges lodged against them”.

“If only the President listens to the people’s reaction on the ground, he would know that his “bosses” are getting frustrated because he has yet to make a significant decision in his first year in office. Let this decision be the release of political prisoners,” challenged Hilao-Enriquez.

Karapatan recalled that it only took the President’s mother, Corazon Aquino less than a month to release majority, if not all political prisoners during her time through a general, unconditional and omnibus amnesty during her first year in office.

“It is ironic that President Noynoy Aquino boasts of his parents’ legacy—that of fighting and dying for democracy in this country—while the number of political prisoners continues to rise in his government, under his “matuwid na daan,” remarked Hilao-Enriquez.

Political Prisoners, according to Karapatan are victims of political persecution because of their political beliefs, but are falsely charged with common crimes to conceal their existence. They are mostly illegally arrested and detained, without warrants of arrests, if not faulty ones. They have also been subjected to different forms of torture while under the custody of the Armed Forces of the Philippines (AFP) and/or the Philippine National Police (PNP).

Hilao-Enriquez reiterates that, “for a self professed human rights advocate, Pres. Aquino should walk the talk now. We are giving him the opportunity to prove the people wrong by releasing the political prisoners now. In the first place, the political prisoners shouldn’t have been in prison if this country is truly democratic and free, as he said so in his speech on June 12.’’ ###

Political Prisoners and Political Detainees

 

·        Political prisoners are victims of the government’s covert policy of political persecution against persons with different political beliefs.

 

·        They are those who were charged or convicted with political and/or common crimes, arrested, detained and/or imprisoned for acts to further their political belief or are victims of political repression.

Free All Political Prisoners

Grant “General, unconditional and omnibus amnesty to all

 

General                 means all political prisoners, alleged political offenders or others as defined in the preceding paragraph and covered by the effectivity of an amnesty proclamation. 

Unconditional      means no precondition is set before they can be released.  They will not have to go through the tedious application process and will not be required to plead guilty or make any admissions. They only need to be covered by the definition and effectivity of the Proclamation. The operative act to effect their immediate release is their inclusion in a pre-screened list and mere acceptance of the General, Unconditional and Omnibus Amnesty Proclamation.

Omnibus               means that all charges or offenses as defined in the Proclamation are covered by the amnesty.

 

 

Sample Cases:

 

·        Rolando Pañamogan, was unjustly charged and convicted with frustrated murder and is now detained in NBP, is among those who need to be immediately released especially because he has been suffering from diabetes, deep toxic goiter, and congestive heart failure. Pañamogan is currently confined at the NBP Hospital due to lowered blood pressure as complications of his diabetes, where facilities and attending medical personnel are scarce. Pañamogan was arrested in 2002.

 

·        Emeterio Antalan, 51 years old, an NDF consultant to the peace talks and a JASIG holder has been suffering from kidney problem and fluctuating blood pressure. He collapsed while inside the jail. Antalan was charged with murder.

 

·        Political prisoner Ernesto Dumlao, who is suffering from asthma, has been sleeping on the floor of the dingy and smelly hallways of the Quezon City Jail, where about 3,400 inmates are being housed, because he cannot pay for a “tarima” that costs P3,000.00

 

·         Husband and wife Jesus and Moreta Alegre, 65 and 64 years old respectively, are among the oldest detainees at present. Jesus and Moreta, together with their 34-year old son Selman, were charged with murder and have been in detention since 2005.
