Arroyo Had Command Responsibility of AFP,
Impunity Must End!

 

The United Church of Christ in the Philippines (UCCP) is committed to ending the culture and climate of impunity in the Philippines.  To this end, today we file a legal suit against Gloria Macapagal Arroyo.  While Arroyo was President and of the Republic and Commander-in-Chief of the Armed Forces of the Philippines, numerous Church Pastors and Church leaders were either been liquidated, harassed, unlawfully, detained or tortured with impunity, by military agents and operatives who, by law, were then all under the ultimate control and command responsibility of Gloria Macapagal Arroyo.  Representing UCCP as General Secretary, Bishop Reuel Norman O. Marigza joins with six UCCP families as plaintiffs against Gloria Macapagal-Arroyo for damages to the Church and Co-Plaintiffs Human Rights Violations Victims.   Gloria Arroyo and the military agents for whom she was responsible must be held accountable for the injustice they have exacted on the Church and the Filipino people.

 

The courageous persons that unites in this action represent:

·         Joel Baclao, UCCP Coordinator of Disaster Relief Program “Andurog-Bicol” at the  time he was extra-judicially killed on November 10, 2004

·         Rev. Edison Lapuz, Conference Minister of the Northeastern Leyte Conference at the time he was extra-judicially killed on May 12, 2005.

·         Pastor Andy Pawican, Licentiate Pastor assigned to UCCP congregation in Pantabangan at the time he was extra-judicially killed on May 21, 2006

·         Rev. Raul Domingo, Deputy Conference Minister of Palawan Associate Conference at the time he was extra-judicially killed on August 20, 2005

·         Noel “Noli” Capulong, Chair of UCCP’s Christian Witness and Service Program in Calamba at the time he was extra-judicially killed on May 27, 2006

·         and representing himself, Pastor Berlin Guerrero, Licentiate Pastor of Northeast Southern Tagalog Conference, who was abducted, illegally detained and tortured on May 27, 2007. 

From over one thousand documented Human Rights Violations under the administration of President Gloria Macapagal Arroyo, more than 18 persons killed extra-judicially, 1 person disappeared and believed killed, 3 persons ambushed and wounded, and at least 4 persons abducted, illegally detained and tortured from the UCCP.

 

As the United Church of Christ in the Philippines, we take action against the relentless persecution and brutalization of the Church, especially being labeled as “ENEMY OF THE STATE” through various counter-insurgency operation plans of the military establishment.  This false and malicious tagging has unjustly permitted for UCCP persons to be “neutralized” in the name of so-called national security,

 

Not only has then President and Commander-in Chief of the Armed Forces of the Philippines Gloria Macapagal Arroyo been prosecuted for the staggering number of extra-judicial killings and human rights violations under her command, but neither have any of the actual military perpetrators been brought to justice. We seek justice for the surviving families of UCCP ordained ministers, pastors, lay leaders and members who had been liquidated through extra-judicial killing as well as those who had been ambushed and wounded, harassed, tortured and illegally detained with impunity. 

We covet the prayers and solidarity support of the Filipino people as we take this action to break the culture and climate of impunity in the Philippines and pursue justice for the victims of human rights violations.

Please support the UCCP in the filing of this civil case against Gloria Macapagal Arroyo for human rights violations that occurred while she was not only the highest public officer of the land, but also Commander-in-Chief of the Armed Forces of the Philippines. We seek justice for the surviving families of UCCP ordained ministers, pastors, lay leaders and members who had been liquidated through extra-judicial killing as well as those who had been ambushed and wounded, harassed, tortured and illegally detained with impunity.
 

Highlighted cases include those of Rev. Edison Lapuz, Conference Minister of the Northeastern Leyte Conference at the time he was extra-judicially killed on May 12, 2005, Rev. Raul Domingo, Deputy Conference Minister of Palawan Associate Conference at the time he was extra-judicially killed on August 20, 2005 and Pastor Berlin Guerrero, Licentiate Pastor of North-East Southern Tagalog Conference, who was abducted, illegally detained and tortured on October 24, 2007. The UCCP documented Human Rights Violations under the administration of President Gloria Macapagal Arroyo number more than 18 persons killed extra-judicially, 1 person disappeared and believed killed, 3 persons ambushed and wounded, and at least 4 persons abducted, illegally detained and tortured. Many of the families and survivors will be joining the legal suit.
 

Not only has then President and Commander-in Chief of the Armed Forces of the Philippines Gloria Macapagal Arroyo never been prosecuted for the staggering number of extra-judicial killings and human rights violations under her command, but neither have any of the actual military perpetrators been brought to justice. STATEMENT OF SUPPORT FOR THE UCCP LEGAL SUIT

“Righteousness and justice are the foundations of your throne; love and truth go before your face.” Psalm 89:14

With this exultant hymn, the National Council of Churches in the Philippines lauds the recourse of the United Church of Christ in the Philippines to seek legal redress in the pursuit of justice for her pastors and church workers who have been victims of extrajudicial killings, warrantless arrests, illegal detention and other forms of human rights violations.

Something indeed is terribly wrong when pastors and church workers are killed, arrested and detained or go missing while they are teaching people to know, defend and fight for their rights.

Today, I affirm the words of my predecessor “…the defense of human rights is a commitment rooted in our being as churches. Faith communities are called to loving service and ensure that human dignity is preserved at all times and in all places. Pursuing this service and witness is at once a call to discipleship. Thus, even as she promotes the rights of people to express and articulate their needs and aspirations freely, the church is vigilant in defending the people from the oppression of others, from the arbitrary use of power, from unjust structures of society and from any other threat that prevents the attainment of abundant life.”

The cry of our sisters and brothers unjustly vexed call on us today to stand firm and persist in demanding justice. The legal steps that the UCCP is undertaking is a leap of faith much more so in a system that shows partiality to those in position of wealth and power. Yet undaunted, the UCCP’s faith is firm and like that of Mary, as it is ours: “His mercy is on those who fear him from generation to generation. He has shown strength with his arm, he has scattered the proud in their conceit. He has cast down the mighty from their thrones and has lifted up the lowly. He has filled the hungry with good things, and the rich he sent away empty.” (Luke 1:50-53)

May God grant us all to persevere in the name of all that is just and peaceful.

Statement on the Extra-judicial killing, harassment, land grabbing, and other rights violations in Casiguran, Aurora.

WITH local Church of the Apostolic Vicariate of Infanta, we in the National Secretariat for Social Action (NASSA), strongly condemn the murder of one of our advocates for indigenous peoples’ rights in Casiguran, Aurora. Armando Maximino, Chieftain of the Agtas in Sitio Delebsong, Barangay Nipoo was shot dead last May 17.

 

The suspected perpetrators belonged to the security personnel enlisted by the contesting party that falsely claims ownership of the ancestral domain, even with the reported knowledge of the city mayor, local police, and other officials. Denied burial at his property among departed kin, Armando was instead laid to rest at the site where he took not one but several bullets.

 

When the Agtas briefly left their vigil at the grave, they returned to find six of their houses burned. Previously, barbed-wire fences were installed around their property by the suspects. When they questioned the move, five members of their tribe were arrested, with some women wounded from the resulting scuffle, but eventually released because there were no grounds to file charges against them.

 

Despite longstanding and rightful ownership of 49 hectares of the disputed land, supported by official documents and upheld by the National Commission on Indigenous Peoples (NCIP), Armando, members of his family and community, have endured threats, harassment, and outright violence. Against powerful enemies, the Agtas have retreated out of fear and left the area.

 

The Church, in its prophetic ministry of promoting social justice, stands in solidarity with the indigenous people’s in their struggle for their rightful claim for the land. We condemn the senseless killing of the Agta Chieftain, Armando Maximino, and the continuing suppression to silence the protest of the community against the impending development aggression.

 

We enjoin all Filipinos to do the same and demand the impartial and comprehensive investigation of the incident, and its swift and just resolution.

 

We appeal to President Benigno Aquino III and concerned government agencies to uphold our laws on indigenous peoples’ rights and agrarian reform, in order to safeguard the welfare of our local communities, as well as the fundamental freedoms violated by Armando’s adversaries.

 

His death exemplifies a recurring cautionary tale, when equal access to resources and justice by vulnerable sectors is continually denied. It underscores the need to address the absence of truly participatory and people-centered development programs, in order to bridge the social, political, and economic divide that bring about conflict in areas like Aurora.

 

And in fulfillment of our mission we believe that “before today’s forms of exploitation of the poor, the Church cannot remain silent . . . she condemns many injustices which unfortunately, even today are committed to the detriment of the poor” (Pope Jouh Paul II, quoted in PCP II, Acts No. 131).
