Respect for human rights should not just be in words

Human rights group Karapatan chided the military’s so-called renewal of “commitment to uphold human rights” amidst the continuing rights violations, injustice and impunity under the P-Noy administration.
 

Jigs Clamor, deputy secretary general of Karapatan said that “commitment to human rights means the pullout of the military from the communities, the end to extrajudicial killings, enforced disappearances, illegal arrests, detention and torture, and the end to the implementation of Oplan Bayanihan.” He further asserted that, “until these are done, such commitment is empty and would remain to be just a part of the military’s psywar tactics.”
 

Karapatan also scoffed at the declaration of Lt. Gen. Jessie Dellosa, chief of Northern Luzon Command that his office has not received “reports of human rights abuses in the last four months.” Karapatan documented seven cases of extrajudicial killings from August to October, including the killing of Fr. Fausto Tentorio and Ramon Batoy in October and the seven year-old child Sunshine Jabinez in Compostela Valley last September. Karapatan documented a total of 64 victims of extrajudicial killings under the P-Noy administration.
 

“If the military has not received reports of rights abuses, that does not mean there are no violations. It only means the people don’t trust the military,” said Clamor. According to Karapatan, victims of rights violations or their families do not report to the military because the prime violator is the military itself. Clamor added that, “the mere presence of the military in the communities already endangers the people.”
From August to October, almost 4,000 individuals from Surigao del Sur, Davao City, North Cotabato and Agusan del Norte were forced to leave their homes and their sources of livelihood because of intense military operations in their communities.


“The military could have their daily dose of “panata sa karapatang pantao” but for as long as the P-Noy administration continues to implement its counter-insurgency program Oplan Bayanihan, there would be no let up in human rights violations.”###

SELDA Welcomes House Resolution for Immediate Release of Political Prisoners, Urge P-NOY to Release PPs this December

Former political prisoners led by the Samahan ng Ex-detainees Laban sa Detensyon at Aresto today welcomed the recently filed resolution of some 38 congresspersons strongly urging Pres. Benigno “Noynoy” Aquino III “to grant general, unconditional, and omnibus amnesty to political prisoners…who are victims of political repression and charged or convicted of political and/or common crimes on acts in furtherance of their political beliefs.”

Among those who initiated the House Resolution 1956 are Teddy Casiño, Neri Colmenares, Rafael Mariano, Luz Ilagan, Emmi de Jesus, Raymond Palatino, Antonio Tinio, Emil Ong, Philip Pichay, Bernadette Herrera–Dy, Susan Yap, Pryde Henry Teves, Florencio Noel, Nelson Dayanghirang, Florencio Flores Jr., Benjo Benaldo, Carol Jayne Lopez, Vicente Belmonte, Abigail Faye Ferriol, Rommel Amatong, Joselito Mendoza, Benhur Salimbangon, Nancy Catamco, Fatima Aliah Dimaporo, Joseph Victor Ejercito, Teddy Baguilat Jr., Benjamin Asilo, Winnie Castelo, Agapito Guanlao, Fernando Gonzalez, Rosendo s. Labadlabad, Pangalian Balindong, Acmad Tomawis, Marcelino Teodoro, Arturo Robes, Sherwin Tugna, Nur Jaafar, and Tupay Loong.

Angie Ipong, secretary general of SELDA, said most of the 356 political prisoners, some 250 of them, were victims of political persecution under the Arroyo administration, as they were illegally arrested, tortured and detained under her rule. 78 are arrested and detained under the present administration.

“They were charged with fabricated criminal cases to cover up their political persecution. Of this number, 13 are elderly, 43 are sick and 35 are women political prisoners. Pres. Aquino should heed this growing call for their immediate release for just and humanitarian reasons. Like what he did last year with the Morong 43, he should grant the unconditional release of political prisoners this December,” Ipong said.

Lined up as priorities for release are the following:

a. The ten political prisoners who were supposed to have been released in 2001 and 2004 as agreed upon in the peace talks before it was scuttled by the Arroyo government, namely: Matricio Manuelito, Joshue Ungsod, Juanito Itaas, Rogelio Natividad, and Darwin Rojas (2001); Ricardo Solangon, Galo Omar, Palili Jammang, Moner Taufic and Abubakar Bimbas (2004)

b. The elderly, ailing and long-detained PPs who should be expeditiously released on humanitarian grounds, specifically Rolando Paniamogan, the Alegre family, Sandino Esguerra, and Mohamadiya Hamja

c. The remaining NDFP consultants in jail who are protected by the Joint Agreement on Safety and Immunity Guarantees (JASIG) and, based on the GPH Negotiating Panel’s commitment last February in Oslo to release most, if not all, political prisoners. Specifically they are Alan Jazmines, Tirso Alcantara, Randy Malayao, Edgardo Friginal, Eduardo Sarmiento, Leopoldo Caloza, Emeterio Antalan, Ramon Patriarca, Danilo Badayos, Alfredo Mapano, Pedro Codaste, and Edwin Brigano

d. Hors de combat Vanessa de los Reyes, a young woman NPA guerilla who is now paralyzed from the waist down after her spine was hit with a bullet

e. The 35 women political prisoners who are all vulnerable to sexual harassment and violence while in prison, in addition to what other PPs suffer.

f. Ericson Acosta and Maricon Montajes, two artists from UP Diliman who chose to study and delve into the situation of farmers and articulate their plight through their crafts, are charged with illegal possession of explosives and firearms.

Oplan Bayanihan is Hamleting Arakan, North Cotabato; Unleashes Wrath as Killings and Evacuations Intensify in Lumad and Peasant Communities

The atrocities perpetrated by the military in Arakan, North Cotabato have intensifying after the death of Italian missionary, Fr. Fausto “Pops” Tentorio of the Pontifical Institute for Foreign Missions (PIME).

We, from the Karapatan Southern Mindanao, Alliance for the Advancement of Human Rights condemns in the highest terms the recent case of human rights violations perpetrated by the 57th and 38th Infantry Battalions and 10th Special Forces Airborne of the Armed Forces of the Philippines in Arakan Valley, North Cotabato.

From the recent independent fact-finding investigation carried out by human rights advocates, with documentations headed by Karapatan last October 21, it was found out that a case of extrajudicial killing, frustrated massacre, illegal arrests, indiscriminate firing and forcible evacuation perpetrated by the composite team 57th and 38th Infantry Battalions and 10th Special Forces of the AFP occurred last October 20.

Ramon Batoy, peasant-farmer killed by 57th Infantry Battalion

According to the reports, last October 20, at aroung 6:00 am, elements of the army’s composite team insisted to enter the house of a peasant-farmer Ramon Batoy, 35 years old, a resident of Sitio Upper Lumbo, Brgy. Kabalantian.

When Ramon Batoy resisted, he was butt-stroked by the soldier. Trying to defend himself and his family, he struck the soldier with his bolo instantly killing the latter. Three soldiers nearby, one of whom was covering his face with a mask, riddled Batoy with bullets and strafed the house and seven other houses nearby. Batoy’s wife, Gina, 33 years old and 6-months pregnant managed to escape with her daughter and son. The military is accusing Batoy as member of the New People’s Army. The military now insists that Batoy was killed in a legitimate encounter.

Batoy is also an active supporter of Bantay Katubigan and Bantay Kalikasan of Mt. Sinaka facilitated by the Municipal Agriculture Office of Arakan. He was also a tenant-farmer of the Mayor of Antipas.

Army soldiers, mauled residents, illegally detained civilians and strafed the community
On the same day, Noli Badol, 35 years-old, farmer and the Sitio leader of Sitio Upper Lumbo, Brgy. Kabalantian, Arakan, was mauled by soldiers from the 57th IB, October 20 while Ramon Batoy was killed. Badol’s legs and hands were tied. His wife, Evelyn, 32 years-old and 8 months pregnant and their children were fired at by the soldiers for three times while attempting to go near Badol and despite their continuous appeals. Badol was taken by the military and was detained at the detachment of the 57th Infantry Battalion for several hours.

Celso Batoy, elder brother of Ramon, 47 years-old, was also mauled and detained by the soldiers together with Badol. Celso and Noli are both currently detained at the police station of Ammas Municipality in North Cotabato with trumped-up charges of illegal possessions of firearms and explosives.

On the other hand, their other brother, Roger Batoy, 44 years-old, was with his wife and stepmother inside their house when the military began the indiscriminate firing at the houses in Sitio Upper Lumbo. Roger’s left foot was hit with the splinters from the firing and suffered minor wounds.

Roger’s wife, Janeth survived the firing when the bullets have just passed over her head.

Arakan Community: Traumatized, heavily-militarized

The attacks against the civilian community of Arakan have resulted to enforced displacement and evacuation of 136 families. On October 20, 43 families from Sitio Lumbo, evacuated to Binoongan Elementary School for fear of more attacks from the military.

While on October 21, more families, numbering 93 evacuated at the same school.

With just three days after their beloved priest, Fr. Pops Tentorio was killed, scores of families, community leaders and civilians are now being attacked by the military.

What kind of peace and development program is reaching the Arakan community? The military’s rhetoric of peace and development programs are actually enforced surrenderees of civilians as NPA, mauling, strafing, harassment, threat, intimidation and killing. We are now seeing the true face of the sugar-coated Oplan Bayanihan counter-insurgency program as scores of human rights violations take place amid the presence of the so-called Peace and Development Teams.

What happened to Sunshine Jabinez, the 7-year-old girl killed by an element of the 71st Infantry Battalion in Pantukan, Compostela Valley? The case of Santos Manrique who was killed because of his opposition to the entry of largescale mining companies in Pantukan, ComVal? What happened to the father and son Rudy and Rudyric Dejos both tortured and killed by the 39th Infantry Battalion in Sta.Cruz, Davao del Sur? How was the case of Rebelyn Pitao, a teacher and daughter of NPA Commander Leoncio “Ka Parago” Pitao? How was the case of the farmer-leader in Davao City, Celso Pojas? Who killed the beloved priest of Arakan, Fr. Fausto Tentorio?

The military’s 10th Infantry Division, Eastern Mindanao Command and the Aquino government’s continuing Oplan Bayanihan shares the blood of these victims on their hands. This is the face of Peace and Development Outreach Program. Their peace is silencing the people’s dissent. Their peace is death to leaders of farmers, church people, and civilians.

KARAPATAN, Alliance for the Advancement of Human Rights is calling the Aquino government, who is the military’s Commander in Chief to bring the perpetrators of these atrocities to prosecution. We are calling the government to pull-out all military troops in the country-sides and to pull-out all peace and development teams.

Peace will never come in silencing dissent. Peace will follow if there is social justice.

Hindi po ako isang propesyunal na sikolohista. Ipagpaumanhin po ninyo, hindi ko po gagap ang komplikasyon at sensya ng sikolohiya. Ang ilalahad ko lang po ngayong hapon ay mga karanasan mula sa aktwal na pakikisangkot at pagtugon sa mga pangangailangang pangkalusugan ng pag-iisip ng mga biktima ng karapatang pantao: mga ina at asawa ng mga lider at myembro ng mga organisasyong pinaslang; kapatid at magulang ng mga aktibistang sinu-surveillance, hinaharas at binabantaan; buo-buong mga komunidad na napapalayas sa kanilang mga tirahan at sakahan para iwasan ang bangis ng militarisasyon sa kanayunan.

Ang programang kontra-insurhensya, sibilyan ang maramihang nabibiktima

Ang babaeng lider-magsasaka na si Sichie Bustamante Gandinao, 56 na taong gulang at ina ng 6 na anak, ay binaril sa harap ng kanyang asawa at mga anak ng mga armadong pinaniniwalaang military noong Marso 10, 2006 sa kanyang bahay sa Salay, Misamis Oriental. Ang pagpaslang sa kanya ay idinulot ng kanyang pagiging saksi sa katatapos lang na pagpatay sa kanyang tiyuhin, ang 73 taong gulang na Dalmacio Gandinao, tagapangulo ng aktibistang grupong Misamis Oriental Farmers’ Association (MOFA) noong Pebrero 2006 na naganap din sa Salay. Ang affidavit ni Sichie na nagdedetalye sa pagpaslang sa kanyang tiyuhin at pagtukoy sa mga bumaril na mga myembro ng grupong paramilitary ay inihain sa United Nations Special Rapporteur Philip Alston kasabay ng kanyang pagbisita sa Mindanao noong Pebrero 18, 2006. Matapos ang dalawampung araw, si Sichie na naman ang pinaslang. Ang kamatayan ni Sichie bilang United Nations witness ay nagdiin sa culture of impunity na umaatake sa mga kanayunan sa bansa ngayon.

May nangyayaring paglabag sa karapatang pantao ng mga mamamayan sa kanayunan. Pinakatampok dito ang 18 kaso ng extra-judicial killings at 5 kaso ng frustrated murder, at 14 kaso ng panonortyur ang naganap sa taong 2006 hanggang 2009 pa lamang dito sa Hilagang Mindanao. Noong 2008, maraming mga organisasyon ng mga magsasaka ang nagreklamo dahil sa panghaharas, paniniktik at pananakot na ginagawa sa kanilang mga organisasyon at mga lider. Ang pulitikal na karahasan ay grabeng nanalanta sa Rehiyon noong 2009 kung saan, sa 27 na biktima ng extra-judicial killings sa buong bansa mula Enero 2009 hanggang Abril 2009, 9 ang dito ang biktimang galing sa Hilagang Mindanao. Sinundan pa ito ng sunod-sunod na pagpatay sa tatlong lider Lumad na sina Datu Mampaagi Belayong, Datu Aladino Badbaran at Datu Alvie Binungkasan mula Setyembre hanggang Nobyembre 2009. Wala ni isa man sa mga salarin ang nakapagbayad ng kanilang krimen. Dagdag pa, 10 lider magsasaka ang sinampahan ng gawa-gawang kaso noong Enero 2009 sa Malayabalay, Bukidnon. Iba pa ito sa 13 lider magsasaka na sinampahan din ng gawa-gawang kaso noong 2009 sa Bukidnon.

Ang mga nabanggit ko na ay mas pinatindi pa nang walang katapusang militarisayon sa mga kanayunan ng Hilagang Mindanao, at syempre pa, ang resulta nitong dislokasyon na nagpapalayas sa mga magsasaka sa kanilang mga tirahan at binubungkal nitong lupa. Sa talaan ng Rural Missionaries of the Philippines noong 2009, may bilang na 3,319 na indibidwal ang naging biktima ng sapilitang paglikas sa mga probinsya nang Bukidnon at Misamis Oriental, hindi pa kasali dito ang bilang ng biktima noong 2010 sa Calabugao, Valencia at marami pang bayan sa Bukidnon dulot nang digmaan at militarisasyon.

Mahirap paniwalaan, pero sa katotohanan, ang sistematikong pag-atake laban sa mga mamamayan sa kanayunan na ipinakita ng extra-judicial killings at paglabag sa iba pang pundamental na kalayaan, ang militarisasyon ng mga komunidad, ay epekto lahat ng kontra-insurhensyang programang National Internal Security Plan (NISP) o mas kilala sa tawag na Oplan Bantay Laya ng nagdaang gobyerno na may tunguhing wakasan ang insurhensya sa taong 2010. Ngunit ang programang ito ay nagpabayad ng mahal sa mga sibilyang mamamayan sa kanayunan dahil ang pinuntirya nito ay hindi lamang mga rebelde, kundi pati na ang mga komunidad ng mga sibilyan at mga mga organisasyong magsasaka na kumikilos namang legal. Ang aplikasyon ng NISP sa mga erya ng Lumad, na tinawag na NISP on Indigenous Peoples ay lalo pang nagpatindi sa culture of impunity sa Hilagang Mindanao dahil binigyang daan nito ang pagtatayo ng mga paramilitary vigilantes gaya ng Task Force Gantangan, Bungkatol Liberation Front, Wild Dogs, Alamara at marami pang iba.

Rehimen ngayon ni Pangulong Benigno Aquino III. Ngunit sa simula pa lang, kanya nang ideneklara ang suporta sa Oplan Bantay Laya. Nito lamang enero, ang NISP ay pinalitan niya ng katawagang Internal Peace and Security Program (IPSP), at ang Oplan Bantay Laya tungong Oplan Bayanihan. Pinangangambahang ang kontra-insurhensyang programang ito ni Aquino ay magpapatuloy lamang sa madugong kontra-insurhensyang programa ng nagdaang rehimen.

Ang paglabag sa mga karapatang pantao at ang epekto nito sa kalusugang mental ng mga mamamayan sa kanayunan

Bumabalik sa aking gunita ang tuluyang pagkasira ng bait ng babaeng anak ni Dalmacio Gandinao, at ang matagal na panahong pagdaramdam ng kanyang pamilya at ng pamilya ni Siche.

Noong huli kung makausap ang panganay na anak ni Datu Alvie Binungkasan sa Gingoog City, Misamis Oriental, wala pa ring patid ang pagdaloy ng kanyang mga luha dulot ng matinding lungkot, at depresyon.

Hanggang ngayon, wala pa ring kapayapaan sa buhay at pag-iisip si Bae Adelfa Belayong, asawa ng pinatay na si Datu Mampaagi Beleayong noong Setyembre 2009 sa Esperanza, Agusan del Sur. Ipinagpatuloy ni Bae Adelfa ang pakikibaka ng kanyang lumisang asawa laban sa higanteng pagmimina sa kanilang lupaing ninuno. Ngayon, si Bae Adelfa naman ang puntriya ng atake. Palipat-lipat siya ng tirahan upang iwasan ang pananakot ng mga militar at paramilitar, at maraming gabing hindi siya pinatutulog ng takot, pangamba at walang-kaseguruhan.

Si Demesia Badbaran sa San Luis, Agusan del Sur, asawa ng pinatay na si Datu Aladino Badbaran, ay nagpamalas ng kanyang kawalang-tiwala sa mga tao sa kapaligiran, sa kanyang komunidad—at sa buhay.

Ang mga paslit sa Syoan sa bulubunduking bahagi ng Misamis Oriental, mga bata sa Lipa, Quezon at sa iba pang bahagi ng Pantaron Range sa Bukidnon na patuloy na nangyayari ang digmaan at paglikas—bakas sa kanilang mga maamong mga mukha ang takot, at pagkailap.

Hindi maikakaila, ang atake laban sa mga aktibista, at ang militarismo sa kanayunan, ay nagdudulot ng trauma sa mga biktima. Ang mga biktima ng mga paglabag sa karapatang pantao ay nakaranas ng mga suliraning mental na direktang idinulot ng tortyur, pagmamaltrato, at dislokasyon. Ang mga suliranin tungkol sa mental na kalusugan ay hindi lamang nakakaapekto sa mga indibidwal na biktima, kundi pati na rin sa kanilang mga pamilya at komunidad. Sa kanayunan kung saan ang kultura ng impunity ay mataas, ang mga mental na sintomas sa mga indibidwal na biktima ng pagtatangkang pagpatay at tortyur ay post traumatic stress disorder at depresyon, habang ang kanilang mga pamilya (lalo na yaong ang mga myembro ay naging biktima nga extra-judicial killings) at mga komunidad ay nagpapakita ng sintomas na nasasaktan. Makikita ito sa kanilang paglimita sa kanilang panlipunang ugnay, kawalang-tiwala sa komunidad at mga tao sa otoridad, at restriksyon ng mga inidibidwal o ng buong komunidad.

Ang mga biktimang ito na nagdurusa sa post-traumatic stress disorder at depresyon ay nagpapakita ng katahimikan tungkol sa mga karanasang nakakasindak, mababang kontrol sa mga negatibong emosyon, at di-pakikisangkot-sosyal. Sa mga komunidad ng mga Lumad at mga Moro na palagian nang napapalayas ng militarisasyon, ang mga bata ay nalalantad sa mga sobrang-laking mga stimuli na nauuwi sa pagdurusa at partikular na mga suliraning kalusugang mental, labas pa sa mga sintomas na psychosomatic, pagluluksa at mga karamdamang may kinalaman sa trauma gaya ng problema sa puso at asthma. Ilan sa mga batang ito ay may malubhang reaksyon sa trauma, na kagaya ng mga sintomas ng post-traumatic stress disorder. Ang mga bata ay tumutugon sa trauma kagaya ng mga matatanda, pero dahil ang pananaw nila sa mundo ay iba, at dahil hindi nila maintindihan ang mga pangyayaring nakakasindak di kagaya ng mga matatanda, sila ay mas nagiging bulnerable.

Pagkasira ng Mental na Kalusugan, Paglabag sa Karapatang Pantao

Ang karapatan sa mental na kalusugan ay karapatang pantao. Kagaya ng karapatan sa pagkain, tirahan, edukasyon at iba pang karapatan, ang karapatan sa malusog na pag-iisip ay isang pundamental na karapatan na kinakailangan upang ang isang indibidwal ay mabuhay ng marangal.

Sa lahat ng pagkakataon, nagsasama ang pisikal, emosyonal at mental na kagalingan ng isang inbidwal upang mabuhay ng marangal. Sabihin pa, papanong ang isang ama ay makakapaghanapbuhay para sa pamilya, ang isang ina ay wastong makapaggagabay sa kanyang mga anak, at ang isang indibidwal ay malayang makakapagdesisyon para sa kanyang sarili kung wala sa malinaw na pag-iisip?

Kailangan kung bigyang-diin ang malinaw na—ang pagseguro sa kabuuang kagalingan ng mamamayan ay obligasyon ng estado, dahilan ito upang kanyang kinakailangan tustusan ang pagbibigay ng mga panlipunang serbisyo mula sa buwis na ibinabayad sa kanya ng mamamayan. Sa kalagayang ang estado mismo ang nagpapatupad ng mga patakarang kontra-insurhensyang sa esensya ay puro-militar at walang pagsasaalang-alang ng mga karapatang pantao—na sa kabilang banda ay siyang nagiging sanhi ng paglabag sa mga karapatang ito at sa iba pang pundamental na kalayaan, at nagdudulot ng mental na pasakit—masasabi nating hindi lamang niya pinabayaan ang kanyang responsibilidad, kundi, siya na mismo ang lumalabag sa obligasyong ipinagkatiwala sa kanya ng mamamayan.

Kawalang Kapayapaan: Magpapatuloy sa Paglabag sa mga Pantaong Karapatan
Ang kawalang kapayapaan sa kanayunan dahil sa hindi maampat-ampat na armadong tunggalian sa pagitan ng Gobyerno ng Pilipinas (GPH) at National Democratic Front (NDF) ay may malubhang epekto sa mga mamamayan. Labas at mas higit pa sa epekto ng aktwal na tunggalian sa mga komunidad, ang rebelyon ang nagbibigay ng lisensya sa gobyerno upang gawing opisyal na palisiya ang mga programang kontra-insurhensya na mabalasik laban sa mamamayan.

Pero hindi rin natin dapat ipasantabi, bagkus ay dapat nating tandaan, na ang pagkasira ng katinuan at malayang pag-iisip ay hindi lamang bunga ng digmaan, o idinulot ng mga paglabag sa mga karapatang sibil at pulitikal. In Oakland and New York City, in Denver and Portland and Chapel Hill, N.C., the 1 percent sent their gun thugs to destroy the Occupy Movement. They want to scare us off the streets and back into the ballot box, beat us back into the good-cop, bad-cop game of the corporate-run Republican and Democratic parties. But behind the façade of electoral politics, the unelected tyrants on Wall Street continue to rule the country. It is they, not the people, who tell the politicians what to do.

The cowardly attacks by Wall Street’s mercenaries in blue were coordinated with the Department of Homeland Security and the Federal Bureau of Investigation. That’s the same FBI whose COINTELPRO program murdered dozens of Black, Latino and Native activists in the ‘60s and ‘70s.

WHEN THE ENEMY ATTACKS YOU, YOU’RE DONG SOMETHING RIGHT

Along with their cops, the 1 percent have unleashed their media. “Enough,” say the billionaire-owned papers and TV stations. “You’ve made your point. Now go home and leave things to the politicians. You’re only the people. What do you think this is, a democracy?” But when the enemy attacks you, you know you’re doing the right thing.

HAS CORPORATE AMERICA STOPPED ATTACKING THE WORKING CLASS

Have the 1 percent stopped laying us off and attacking our wages and benefits? Have they stopped evicting us and foreclosing on our homes? Have they stopped firing teachers and bus drivers and hospital workers while they hoard trillions of dollars that we produced? Have they stopped plotting to gut our Social Security and Medicare and Medicaid, our Postal Service, our schools and hospitals?

Have they stopped denying 30 million people the right to a decent job? Have they stopped denying millions the right to medical care. Have they stopped the mass incarceration of youth of color whose communities the banks and corporations have destroyed. Have they stopped waging bloody and unjust imperialist wars all over the world?

IF THERE IS NO STRUGGLE, THERE IS NO PROGRESS

The immortal words of Frederick Douglas are as true today as they were in 1857. Real change has never been made at the ballot box.

Look at the 1930s. How did we win Social Security and Medicare, the 8-hour day, unemployment insurance and the minimum wage, the right to retire and the right to organize, all the things they want to take away from us. Workers won these things by marching and striking, by occupying factories and physically blocking evictions, by shutting entire cities down.

Look at the 1960s. How did Black people win basic civil rights and overthrow the regime of legal segregation. By marches and boycotts, by sit-ins and rebellions in the streets. The right to vote was not won by voting.

These struggles were also victorious because they were part of a worldwide struggle against the power of monopoly capital.

POWER IS THE ONLY LANGUAGE THE 1 PERCENT UNDERSTAND

And we have power, the power to shut this country down! Oakland dockworkers, members of the International Longshore and Warehouse Union, showed the way when they shut the port down the port on Oct. 25 to protest the police assault on Occupy Oakland.

Karapatan staff receives death threats in Dumaguete, Negros Oriental

On the afternoon of November 8, 2011, while Karapatan coordinator Jose Luis Blanco was resting at the office after a field work, he received a call on his cellphone from an unregistered number (09095596583).

The male caller asked if he is speaking to Jose Luis Blanco. After confirming that he is Blanco, the caller then burst out in a barrage of anti-communist monologue. The caller accused Blanco of being a member of the New People’s Army, and a “God-less automaton of Jose Maria Sison in the Netherlands. The caller threatened Blanco that he will be sexually abused and stabbed to death. The caller also warned that “they” know where Blanco is, and that “they” would have him killed.

Shocked at the caller’s tirade, Blanco could only mutter “ok” during the two-minute call.

When the phone was disconnected, the perpetrator called again.But Blanco turned off his phone. Blanco later reported the incident to the local police.

On November 21, the perpetrator called again, but Blanco did not answer.

Since 2008, Blanco has been receiving threats and harassment because of his human rights work. His person has been vilified on numerous occasion by the 79th Infantry Battalion. He was also falsely charged of kidnapping, direct assault, and more recently, of violation of the Negros Oriental provincial ordinance that regulates the conduct of fact-finding missions.

Recommended action:
Send letters, emails or fax messages calling for:

The immediate formation of an independent fact-finding and investigation team composed of representatives from human rights groups, the Church, local government, and the Commission on Human Rights that will look into threat, harassment and intimidation of Jose Luis Blanco.
The military to stop the labeling and targeting of human rights defenders as “members of front organizations of the communists” and “enemies of the state.”
The Philippine Government to withdraw its counterinsurgency program Oplan Bayanihan, which victimizes innnocent and unarmed civillians.
The Philippine Government to be reminded that it is a signatory to the Universal Declaration of Human Rights and that it is also a party to all the major Human Rights instruments, thus it is bound to observe all of these instruments’ provisions.

Account of the Incident: On June 30, 2011 at around 5 am, Arpe was lying on the floor of his house with his wife Mayse and three children, aged 1 year old, 4 years old and 8 years old, when they heard men on the ground outside their house. About two meters from their house, Arpe's daughter (Michelle), 14 years old and his nephew Solte, 21 years old were asleep in a neighboring house. All of a sudden, gunfire was directed at the house where Michelle and Solte were sleeping. Solte jumped out of the house and was followed by gunfire. Michelle saw Solte fall to the ground as she was hit on the left leg. She rolled down the hillside to hide below.

The gunmen entered the Belayong house and as Arpe tossed his one-year-old daughter to Mayse, he was shot twice on the chest, falling over Adeb, who was still lying on the floor. After seeing Tala Mansinugdan and Laging Binsalan among the armed men who shot Arpe, Mayse jumped out of the house with her baby daughter and eight-year-old son and rolled down the hill to their farm plot below. She saw her wounded teenage daughter and told her to hide. Mayse then ran for two kilometers to get help at the house of Lagdam Hanghadon, her cousin and their nearest neighbors.

Learning of the events in Arpe's house, Lagdam's children Dexter, Donie and Jun-Jun Hangadon returned to the place of the incident at around 9am and saw Arpe's body lying over his four-year-old son (Adeb) who was alive with a leg wound and covered in his father’s blood. They saw the Belayong’s belongings scattered all over the house and some piled over his body. They also retrieved Solte's dead body 3 meters away from Arpe's house. They also found Michelle hiding in the nearby farm at the foot of the hill near their house.

After placing the two dead bodies side by side inside the Belayong house, tying and wrapping them in cloth and plastic sheeting, they were not able to bury the bodies because they were worried that the armed men would go back for them. After arranging the corpses in the house, the Hangadon brothers took Michelle and Adeb back to Lagdam's house where they were reunited with their family.

For fear of the members of the Salakawan patrolling the mountains, it took 10 days for the family to find assistance and seek sanctuary in the lowlands. In the meantime, Michelle and Adeb were treated for their bullet wounds. Mayse, and her two other children are recovering from their experiences.

Background

In March 2011, local Higaonon organization Linundigan, through their elder Datu Man-altuwan requested the Rural Missionaries of the Philippines (RMP), an NGO assisting indigenous peoples in Agusan, to establish a community school in Semontanan, Brgy. Calabuan in the mountains of Esperanza, Agusan del Sur. Understanding the need for such a lumad (indigenous peoples of Mindanao) school and with the community's cooperation, the RMP responded positively to the request.

Arpe Belayong supported Linundigan's initiative to have the RMP school in their community. He was a father of three school-age children and also a member of the Parent-Teacher-Community Organization of their community school in Lawan-Lawan, Las Nieves from where they were displaced two years ago. Although he lived four-days-hike away from the village center of Semontanan in the middle of the forest, he welcomed the building of the school.

On May 11, 2011, Arpe was visited by Bontula, younger brother of Tala Mansinogdan, who told him that Tala was being held captive by Laging Binasalan, a known member of Manpatilan's Wild Dog, now called Salakawan. On May 14, Tala himself visited Arpe and warned him that Laging released him on the condition that Tala convince Arpe to leave his Mansalog home and farm because it is Laging's territory. Mayse asked that they be allowed to harvest their crop before leaving the area.

On June 6, 2011, the staff of RMP with Datu Man-altuwan, Brgy. Captain of Brgy. Calabuan and local members of Linundigan from Semontanan visited the office of Mayor Nida Manpatilan in Brgy. Poblacion, Esperanza, Agusan del Sur. Former Mayor Deo Manpatilan was also in Mayor Nida's office at the time. Only the RMP staff, Datu Man-altuwan and Calabuan village chair were allowed an audience with the Mayor.

During the interview, Deo Manpatilan repeatedly warned Datu Man-altuwan's decision to allow the RMP to start a school in Semontanan, saying that the children would be taught anti-government and subversive songs. He warned the village chair and Datu Man-altuwan that should anything happen to the community related to RMP's running of the school, the Esperanza LGU (local government unit) cannot be held responsible and cannot intervene. In his parting shot, Manpatilan reminded the RMP to strictly follow legal procedure with the Department of Education on the opening of the school.

After their interview, Datu Man-altuwan was brought to Deo Manpatilan's home and was further warned about allowing the RMP into Semontanan. He was presented with the alternative of allowing a logging firm to help them build a school instead.

Despite the threats, RMP was able to get the support of Linundigan, an organization of the Higaonon indigenous peoples, through their resolution, affirming their desire to have a community school in Semontanan.

On the third week of June, Tala returned to Arpe's home to inform him that Laging Binasalan and his Salakawan group was going to launch an operation to clear Mount Manalog.

In 2006, Higaonon communities opposed to self-acclaimed Higaonon tribal leader Ronald Manhumosay's Certificate of Ancestral Domain Title (CADT) claim in the Higaonon ancestral domain areas in Agusan del Norte were harassed by the latter’s armed Bungkatol Liberation Front (BULIF), a paramilitary group formed by the Kahugpungan sa Nagkahiusang Minorya (KNM), a government-initiated tribal organization as part of the “Zone of Peace” effort under the counter-insurgency program, Oplan Lambat Bitag in 1992. It claims representation for the Higaonon in negotiations with the National Commission on Indigenous Peoples (NCIP) and the Tribal Coalition of Mindanao (TRICOM). Datu Ronald Manhumosay is the current president of the KNM. It is the holder of CADT 18, covering communities from Km.30 onwards along the Nasipit Lumber Company (NALCO) road.

Many Higaonons died in connection with this conflict, among them Somo Senga, whose killing was among those reported to UN Special Rapporteur Philip Alston when he visited Mindanao in 2007. Despite reports of killings and harassment perpetrated by private armed groups in claiming territories in the resource-rich Higaonon ancestral domain, the Philippine National Police (PNP) and the Armed Forces of the Philippines (AFP) have tolerated the continued arming of groups such as the BULIF and Manpatilan's Wild Dogs. With the addition of the AFP's Task Force Gantangan – Bagani Force (TFG-BF), more rogue armed bands are roaming the mountains of these areas.

As the harassment escalated in 2007 that resulted in the closure of literacy-numeracy schools in Lawan-Lawan, Las Nieves Agusan del Norte, small Higaonon communities opposed to Manhumosay's claim were displaced deep into the mountains in the boundaries of the four provinces of Agusan del Norte, Agusan del Sur, Misamis Oriental and Bukidnon. Those who relocated from Las Nieves, Agusan del Norte to escape Manhumosay's BULIF and went to the hinterland communities in Esperanza, Agusan del Sur are now prey to Manpatilan's Wild Dog.

In 2009, Datu Mampaagi Belayong, elder and founding chairman of progressive Higaonon organization, Linundigan, was killed in his home in Brgy. Kinamaybay, Esperanza in Agusan del Sur by known members of the TFG-BF and BULIF in a joint operation. Despite first hand witnesses to the killing, no arrests were made. One of the known perpetrators in Datu Mampaagi's killing, Commander Bawang, has verbally attacked progressive organizations and their leaders and has vowed to wipe out their ranks.

As big investors in oil palm plantation and mining focus their interests on the forest areas in Esperanza, Lumad dealers Manpatilan, Manhumosay, Mansulonay and Napongahan who have CADT claims, stand to personally benefit from these firms to the detriment of the larger Lumad communities that they claim to protect. Exploiting the prescriptions of the defective Indigenous People's Rights Act (IPRA) and its corrupt National Commission on the Indigenous Peoples (NCIP), that instead of genuinely respecting the right to self-determination and concretely recognizing their ancestral domain, these instruments have become tools for further exploitation and sell-out of the natural resources that the indigenous peoples in Agusan have preserved for generations.

Leader of small-scale miners killed in Compostela Valley

Four armed men suspected to be hired killers
On April 12, 2011, at around 6 PM, Santos V. Manrique, also known as Ricky, was at the lawn in front of his house in Brgy. Kingking, Pantukan responding to a call in his two-way radio. His wife, Amelia, 46, said she was just a meter away from him, while their six-year-old grandson was also near when a man arrived and shot Ricky three times at the back with a .45 caliber pistol, from a three-and-a-half meter distance.

Amelia said that as soon as Ricky fell, the gunman pointed his gun at her and other members of the family as he stepped backward. The assassin then headed towards the road where three other men were waiting on two TMX motorcycles. Amelia described the gunman to be between 25 and 30 years old with fair complexion, and was in a white t-shirt and white shorts.

With the help of their neighbours and family members, Amelia brought Ricky to the Community Hospital of Pantukan where he was declared dead on arrival. Ricky sustained two gunshot wounds at the back which exited to the right and left side of his chest, and one in the head which hit him on the right side and went through to the left side.

As leader of two groups of small-scale miners, Chair of the municipal chapter of Panalipdan, as well as village councilman, Ricky had been active in the campaign against the entry of big-scale mining.
Panalipdan is a broad alliance of environmentalists and other people’s groups which advocate the defense of the environment, land rights and food sovereignty.

In 2008, Ricky was at the forefront of the campaign against the entry of the Philippine Mining Corporation (PMC).
In 2010, he was the spokesperson of the campaign that initiated the petition-signing against the entry of the Napnapan Minerals Resource Incorporation (NMRI) in Boringot area. The petition was submitted to the municipal council of Pantukan, with a copy furnished to the office of the Pantukan mayor, and forwarded to the office of the Compostela Valley provincial governor.

This year, Ricky was visibly active in lobbying with the local government against the entry of big mining companies.

On January 25, 2011, the Small-Scale Miners’ Cooperative of Boringot led by Ricky filed a petition against the Nationwide Development Corporation (NADECOR) and the Russel Mining Corporation which planned to enter into mining in Boringot. The petition was submitted to the municipal council of Pantukan, with a copy furnished to the Pantukan mayor, and forwarded to the provincial governor. The entry of the two mining companies was approved by the Pantukan municipal council in a resolution in 2009, and was supported by Pantukan Mayor Celso Sarenas.

On March 2, 2011, Ricky and the small-scale miners held a dialogue with Provincial Governor Arturo “Chiongkee” Uy and members of the Provincial Board and discussed the petition submitted in January. The petitioners were joined by Francis Morales, Secretary General of Panalipdan-Southern Mindanao Region, representatives of the Kilusang Magbubukid ng Pilipinas (Peasant Movement of the Philippines), Anakpawis (Toiling Masses) party-list, Katribu party-list and other advocates. The local government officials gave their commitment to support the petition.

On March 9, 2011, elements of the 1001st Infantry Brigade harassed Ricky and his companion in barangay Mipangi, Nabunturan municipality, as they negotiated with the soldiers regarding the claims and relocation of mining in the area.

On March 25, Ricky did not attend the public scoping at the office of the Russel Mining Corporation in Pantukan, where the company presented its mining plans. Ricky had said that he avoided the activity because he knew that he had earned the ire of the authorities in Pantukan because of his involvement in the protest against the entry of big mining in the area.

Ricky’s family suspects that his stand and active involvement in the protest against big mining was the main reason for his killing.

B'laan tribe chieftain and his son tortured and killed in Sta. Cruz, Davao del Sur

On the morning of February 27, Rudy and Rudyric Dejos was working on their respective farms which is near their residence in the village of Zone 1, Sta. Cruz, Davao del Sur.

Rudy's wife, Mercy, left for the village market to sell their crops. When she returned home at around 4:00 PM, she found her husband's and son's lifeless bodies, bathed in blood. The bodies bore gunshot and stab wounds. There were also signs of possible torture as there were bruises on the bodies, and the victims hands and nails were smashed.
Mercy believes that her husband and son were killed around noon because the bodies were already cold and stiff, and the food for lunch that Rudy prepared was left untouched.

In June last year, elements of the 39th Infantry Battalion of the Philippine Army set-up camp in the Barangay Hall in the center of Barangay Zone-1, Sta. Cruz, conducted village meetings (or “pulong-pulong”) and invited residents, including Rudy, to come in and “clear” their names. A rebel returnee and a community organizer named Jojo have told Rudy that the latter has been mistrusted in the village and that he should “clean” his name from the military's record. The military have accused Rudy's tribe as “frontline of the underground movement” and the New People's Army, and should be dismantled. Rudy decided not to go to the Barangay Hall because he believed that, even though he wishes to explain his side, the military would not believe him.

Rudyric, on the other hand, was interrogated by a certain Boyong on June 6, 2010, outside Rudy's home. Boyong asked Rudyric about his brother-in-law suspected of being an NPA guerilla, and even aimed a gun at the latter's head. Boyong also took Rudyric's picture with a cellphone camera without permission.

Also in December 2010, a certain Arman, a leader of the Barangay Defense System1 in the village and a known military intelligence agent, threatened Rudy over the founding of the Zone-1 Farmers Association which is affiliated with the KMP.

* Barangay Defense System (BDS) is a group of civilians formed by the AFP after a massive military counter-insurgency operation in a community. Some of the members of the BDS are forced or coerced to join, and some are given firearms by the AFP.

Recommended action:
Send letters, emails or fax messages calling for:

1. The immediate formation of an independent fact-finding and investigation team composed of representatives from human rights groups, the Church, local government, and the Commission on Human Rights that will look into the extrajudicial killing of Rudy and Rudyric Dejos.

2. The military to immediately leave the communities in Sta. Cruz, Davao del Norte, and to stop the labeling and targeting of human rights defenders as “members of front organizations of the communists” and “enemies of the state.”

3. The Philippine Government to withdraw its counterinsurgency program Oplan Bayanihan, which victimizes innnocent and unarmed civillians

4. The Philippine Government to be reminded that it is a signatory to the Universal Declaration of Human Rights and that it is also a party to all the major Human Rights instruments, thus it is bound to observe all of these instruments’ provisions.
